How to use this Demand Letter in New Jersey

Write the facts in order with dates, state the exact amount, give 10–14 days, and say you will file in the Superior Court, Special Civil Part (Small Claims Section) (limit $5,000.00).

Send by certified mail with return receipt plus email, keep copies of everything, and file the claim the day after the deadline passes if nothing arrives.

Do I have to send a demand letter before small claims in New Jersey?

Some courts require a written demand before you file, and every judge expects one: it shows you tried to resolve the matter and it fixes the amount and the date the other side was on notice. Send it by certified mail and keep the receipt — it is usually Exhibit A.

How much can I sue for in New Jersey small claims court?

Up to $5,000.00 in the Superior Court, Special Civil Part (Small Claims Section) (N.J. Ct. R. 6:1-2). Larger claims go to the regular civil court, or you can waive the excess.

Can I add interest and late fees?

Only what the contract, invoice terms or a statute allows. If nothing was agreed, demand the principal and tell them you will ask the court for pre-judgment interest and costs; courts award those on their own rules. Inventing fees weakens the letter.
