How to Serve an Eviction Notice in Ohio (2026): Notice Periods, Delivery Rules and What Happens Next

2. What the notice must say

3-day notice must contain, in conspicuous type: 'You are being asked to leave the premises. If you do not leave, an eviction action may be initiated against you. If you are in doubt regarding your legal rights and obligations as a tenant, it is recommended that you seek legal assistance.'

3. Serve it the way the statute allows

Permitted methods in Ohio (Ohio Rev. Code § 1923.04(A) (handing to tenant, leaving at usual place of abode, or certified mail)):

  • Personal delivery to the tenant
  • Delivery to a person of suitable age at the premises + first-class mail
  • Posting in a conspicuous place on the premises
  • Certified mail, return receipt requested

Write down the date, time, method and the name of anyone you handed it to — that becomes the proof of service the court will ask for. If a method involves mailing, keep the receipt.

4. Count the days correctly

Count calendar days, starting the day after service. If the last day lands on a weekend or holiday, the safe practice is to wait until the next business day before filing. For properties with a federally backed mortgage or federal subsidy the CARES Act requires 30 days' notice for nonpayment regardless of the state period.

5. What trips landlords up in Ohio

  • Leaving out the statutory warning. The notice must say, in conspicuous type: “You are being asked to leave the premises. If you do not leave, an eviction action may be initiated against you. If you are in doubt regarding your legal rights and obligations as a tenant, it is recommended that you seek legal assistance.” Without it the notice is defective.
  • Treating it as a pay-or-quit notice. Ohio's notice asks the tenant to leave; there is no statutory right to cure by paying within the three days.
  • Accepting rent after serving the notice. Taking rent for a period after the notice can be treated as waiving it; if you accept money, do so only for arrears and in writing without waiver, or serve a new notice.
  • Shutting off utilities or changing the locks. Self-help is barred by § 5321.15 and gives the tenant a damages claim.

6. After the deadline

After the three days, file a forcible entry and detainer complaint in the municipal or county court for the area. The court serves the tenant and sets a hearing; if you win possession, the court's bailiff schedules the set-out, and the tenant must be given time before removal. Back rent can be claimed in the same case as a second cause of action.
