Как использовать Дополнительное соглашение к строительному договору (Change Order) в штате US
Норма штата your state о письменном изменении не подтверждена, поэтому вопрос решают пункт самого договора и общее договорное право (Common law of contracts; state statute of frauds). Допсоглашение — не новый договор: оно называет исходный договор и его дату, точно описывает, что меняется, оценивает изменение и указывает, как оно влияет на дату завершения. Всё остальное в договоре продолжает действовать.
Считайте цену так, чтобы собственник мог её проверить. Позиции — количество на цену за единицу, работы и материалы отдельно — выдерживают спор; твёрдая сумма годится для мелких очевидных работ. Прямо укажите, добавляется сумма или вычитается, и доведите арифметику до конца: исходная цена плюс итог прежних изменений плюс или минус это — новая цена договора. Именно она должна стоять в следующем счёте, в заявке на транш и в любом требовании о залоге.
Срок и деньги решайте в одном документе. Влияние на срок пишите целыми днями, даже если это ноль: пустая строка обычно оставляет в силе прежнюю дату, и подрядчик оказывается просрочившим из-за изменения, о котором просил собственник. По оплате законный лимит для штата your state не подтверждён — действует договор; выставлять счёт по мере выполнения изменённых работ безопаснее всего. Аванс за материал под заказ — разумное исключение.
Подписывайте до начала изменённых работ и в тот же день отдавайте копию собственнику. Подпись до работ делает изменение доказуемым: из документов видно, что цену согласовали заранее, а не выторговали потом.. Храните подписанное изменение вместе с договором, счетами и отказами от залога.
