如何在美国使用施工变更单
未确认您所在的州有要求书面变更单的全州性规则，因此由合同自身的变更条款和一般合同法决定（Common law of contracts; state statute of frauds）。变更单不是新合同：它写明原合同及其日期，准确描述变更内容，给出价格，并说明对完工日期的影响。合同其余内容一律继续有效。
报价要让业主能够核对。逐项明细——数量乘单价、人工与材料分列——才能在争议中站得住；一口价只适合小而明确的活儿。写清楚金额是计入还是扣减，并把算式贯彻到底：原合同价，加上以往变更的净额，再加减本次金额，等于修订后的合同总价。这个数字才是下一张发票、银行放款申请和任何留置权主张上唯一应出现的价格。
工期与款项要在同一份文件里解决。工期影响用整天数写明，哪怕是零——留空通常仍以原完工日期为准，承包商就会因业主自己提出的变更而逾期。在付款方面，未确认您所在的州有法定限制，因此以合同为准；按变更工作的完成进度开票最为稳妥。为特殊订购材料预付定金，是唯一合理的例外。
在变更工作开始前签署，并当天把副本交给业主。先签字才能让变更单可被证明：材料显示价格是在动工前谈定的，而不是事后争来的。请把签署的变更单与合同、发票和留置权放弃书一并保存——它们合起来才是这项工程真实造价的全部记录。
