Does a contract make someone an independent contractor in Florida?

No. Florida applies the common-law control test (Fla. Stat. § 443.1216(1)(d) (unemployment: common-law control test); Fla. Stat. § 440.02(15)(d) (workers' comp statutory factors)) to the actual relationship. This agreement is drafted to support contractor status, but the parties must also behave accordingly: the contractor controls how the work is done, uses its own tools, works for others.

Is there a freelancer payment law in Florida?

No statewide freelance law; general contract law and this agreement's payment terms govern.

Can I add a non-compete?

In Florida: yes (Fla. Stat. § 542.335 (applies to employees, agents and independent contractors); CHOICE Act, Fla. Stat. §§ 542.41-542.45 (eff. July 1, 2025; up to 4-year covered non-competes)). This template deliberately omits non-competes. A narrow non-solicitation clause is optional (Fla. Stat. § 542.335(1)(b)).
