No. Montana applies the classification tests (Mont. Code § 39-71-417 (Independent Contractor Exemption Certificate required to be a contractor for WC/UI/wage purposes); Mont. Code § 39-71-401(3) (two-part test: free from control and independently established business)) to the actual relationship. This agreement is drafted to support contractor status, but the parties must also behave accordingly: the contractor controls how the work is done, uses its own tools and works for others.
