How to use this Independent Contractor Agreement in Illinois
Describe the deliverables, not the hours; let the contractor set the schedule and use their own tools. Collect a W-9 before the first payment and file a 1099-NEC if you pay $600 or more in a year.
Pay on time — Illinois's freelance law adds penalties for late payment.
Frequently asked questions
Does a contract make someone an independent contractor in Illinois?
No. Illinois applies the classification tests (820 ILCS 405/212 (unemployment ABC test); 820 ILCS 185/10 (Employee Classification Act, construction ABC); Minimum Wage Law uses economic-reality test (56 Ill. Adm. Code 210.110)) to the actual relationship. This agreement is drafted to support contractor status, but the parties must also behave accordingly: the contractor controls how the work is done, uses its own tools and works for others.
Is there a freelancer payment law in Illinois?
Yes — Freelance Worker Protection Act (820 ILCS 192/1 et seq. (P.A. 103-0417, eff. July 1, 2024)): written contract required for work over $500.00, payment within 30 days.
Can I add a non-compete?
In Illinois: yes (820 ILCS 90 (Freedom to Work Act: employees earning < $75,000 (< $80,000 from Jan. 1, 2027); 14-day review; applies to employees only)). This template deliberately omits non-competes; a narrow non-solicitation clause is optional.
