How to use this Employment Agreement / Offer Letter in New Hampshire
Decide exempt vs. non-exempt honestly: the salary floor and the duties test both matter, and misclassification is the most expensive payroll mistake.
Give the signed offer letter or agreement before the first day, together with the New Hampshire new-hire wage notice (RSA 275:49), and complete Form I-9 within three business days of the start date.
Non-compete timing: copy of the covenant must be provided before acceptance of the offer (or of the change in job classification) (RSA 275:70) (RSA 275:70). Late delivery makes the covenant unenforceable; it is void anyway below $30,160.00 per year.
Frequently asked questions
Can I include a non-compete in New Hampshire?
Only within statutory limits (RSA 275:70): Copy must be provided before acceptance of offer or change in job; void for employees earning ≤ 200% federal minimum wage ($14.50/hr); physicians/PAs/physician associates protected (SB 402, eff. July 7, 2026). The wizard omits the covenant when the employee's pay or status does not qualify and prints any required notice.
When is the final paycheck due in New Hampshire?
