How to use this Employment Agreement / Offer Letter in Maine

Decide exempt vs. non-exempt honestly: the salary floor and the duties test both matter, and misclassification is the most expensive payroll mistake.

Give the signed offer letter or agreement before the first day, and complete Form I-9 within three business days of the start date.

Non-compete timing: employer must disclose before the offer that a non-compete is required and give a copy at least 3 business days before the signing deadline (26 M.R.S. § 599-A(4)); covenant takes effect no earlier than one year of employment or six months after signing, whichever is later (26 M.R.S. § 599-A). Late delivery makes the covenant unenforceable; it is void anyway below $63,840.00 per year.

Pay transparency: Maine requires the pay range in every job posting (26 M.R.S. § 628-B (LD 1849, 2026)); the offer letter states the range you enter.

Can I include a non-compete in Maine?
