How to use this Employment Agreement / Offer Letter in New Jersey

Decide exempt vs. non-exempt honestly: the salary floor and the duties test both matter, and misclassification is the most expensive payroll mistake.

Give the signed offer letter or agreement before the first day, together with the New Jersey new-hire wage notice (N.J.S.A. § 34:11-4.6; N.J.S.A. § 34:11-58.4), and complete Form I-9 within three business days of the start date.

Pay transparency: New Jersey requires the pay range in every job posting (N.J.S.A. § 34:6B-23 (Pay Transparency Act, P.L. 2024, c. 91)); the offer letter states the range you enter.

Frequently asked questions

Can I include a non-compete in New Jersey?

Yes, if reasonable in time, area and scope and supported by a legitimate business interest (Solari Industries v. Malady, 55 N.J. 571 (1970)). Common-law Solari/Whitmyer reasonableness; courts blue-pencil; S1407/A1829 near-total ban pending.

When is the final paycheck due in New Jersey?

If discharged: next regular payday. If the employee resigns: next regular payday (N.J.S.A. § 34:11-4.3). Wages must otherwise be paid at least twice each calendar month on regular paydays designated in advance (executive and supervisory employees may be paid monthly) (N.J.S.A. § 34:11-4.2).

Does New Jersey require paid sick leave?

Yes — New Jersey Earned Sick Leave Law (N.J.S.A. §§ 34:11D-1 to 34:11D-11): 1 hour per 30 hours worked, up to 40 hours per year; applies to all employers. Local ordinances: none — state law preempts.

What salary makes an employee exempt in New Jersey?

$684 per week ($35,568 per year) under the federal FLSA (29 C.F.R. § 541.600); New Jersey sets no higher floor. The duties test must also be met.

Does New Jersey limit invention assignment?

Yes. N.J.S.A. § 34:1B-265 limits assignment to work-related inventions; the agreement prints the statutory carve-out in Section 6.
