How to use this Employment Agreement / Offer Letter in Louisiana

Decide exempt vs. non-exempt honestly: the salary floor and the duties test both matter, and misclassification is the most expensive payroll mistake.

Give the signed offer letter or agreement before the first day, together with the Louisiana new-hire wage notice (La. R.S. § 23:633), and complete Form I-9 within three business days of the start date.

Non-compete timing: covenant must list the specific parishes, municipalities or parts thereof where the employer carries on a like business (La. R.S. § 23:921(C)) (La. R.S. § 23:921). Late delivery makes the covenant unenforceable.

Can I include a non-compete in Louisiana?

Only within statutory limits (La. R.S. § 23:921): Void unless within statutory exception: max 2 years post-termination and must list specific parishes/municipalities; physician limits (primary care: no covenant after 3 years; others after 5 years) eff. Jan. 1, 2025; interns/apprentices barred eff. Aug. 1, 2026. The wizard omits the covenant when the employee's pay or status does not qualify and prints any required notice.

When is the final paycheck due in Louisiana?
