How to use this Employment Agreement / Offer Letter in Oregon
Decide exempt vs. non-exempt honestly: the salary floor and the duties test both matter, and misclassification is the most expensive payroll mistake.
Give the signed offer letter or agreement before the first day, and complete Form I-9 within three business days of the start date.
Non-compete timing: written statement that a non-compete is required, delivered at least two weeks before the first day of employment (or the covenant is entered on a bona fide advancement); signed copy delivered within 30 days after termination (ORS 653.295). Late delivery makes the covenant unenforceable; it is void anyway below $119,541.00 per year.
Frequently asked questions
Can I include a non-compete in Oregon?
Only within statutory limits (ORS 653.295): Void unless: written notice 2 weeks before start (or bona fide advancement), employee is exempt, salary ≥ $119,541 (2026, indexed), protectable interest, ≤ 12 months, and signed copy provided within 30 days of termination; medical licensees limited (ORS §§ 58.375-.376, 2025). The wizard omits the covenant when the employee's pay or status does not qualify and prints any required notice.
When is the final paycheck due in Oregon?
If discharged: by the end of the next business day. If the employee resigns: immediately if the employee gave at least 48 hours' notice; otherwise within 5 business days or the next regular payday, whichever is earlier (ORS 652.140). Wages must otherwise be paid regular paydays no more than 35 days apart (ORS 652.120).
Does Oregon require paid sick leave?
Yes — Oregon Sick Time law (ORS 653.601 to 653.661): 1 hour per 30 hours worked, up to 40 hours per year (unpaid for employers with fewer than 10 employees; 6 in Portland); applies to 10+ employees for paid time. Local ordinances: Portland (6-employee threshold).
What salary makes an employee exempt in Oregon?
$684 per week ($35,568 per year) under the federal FLSA (29 C.F.R. § 541.600); Oregon sets no higher floor. The duties test must also be met.
Does Oregon limit invention assignment?
No statute; the agreement's own carve-out for unrelated own-time inventions applies.
