How to use this Employment Agreement / Offer Letter in Utah
Decide exempt vs. non-exempt honestly: the salary floor and the duties test both matter, and misclassification is the most expensive payroll mistake.
Give the signed offer letter or agreement before the first day, together with the Utah new-hire wage notice (Utah Code § 34-28-3(3)), and complete Form I-9 within three business days of the start date.
Frequently asked questions
Can I include a non-compete in Utah?
Only within statutory limits (Utah Code § 34-51-201): Post-employment restrictive covenants max 1 year; broadcast employees ≤ 1 year and only if earning ≥ $913/wk; healthcare platform contractors (2025) and all licensed clinical healthcare workers (eff. May 6, 2026) barred; veterinarians barred (2026). The wizard omits the covenant when the employee's pay or status does not qualify and prints any required notice.
When is the final paycheck due in Utah?
If discharged: within 24 hours of separation. If the employee resigns: next regular payday (Utah Code § 34-28-5). Wages must otherwise be paid at least semimonthly on regular paydays, within 10 days after the period ends (monthly for employees on a yearly salary) (Utah Code § 34-28-3).
Does Utah require paid sick leave?

What salary makes an employee exempt in Utah?
