How to use this Employment Agreement / Offer Letter in Nevada
Decide exempt vs. non-exempt honestly: the salary floor and the duties test both matter, and misclassification is the most expensive payroll mistake.
Give the signed offer letter or agreement before the first day, together with the Nevada new-hire wage notice (NRS 608.080), and complete Form I-9 within three business days of the start date.
Pay transparency: Nevada requires the pay range on request or after the interview (NRS 613.133); the offer letter states the range you enter.
Frequently asked questions
Can I include a non-compete in Nevada?
Only within statutory limits (NRS 613.195): Void for hourly-paid employees; requires valuable consideration, reasonable scope; cannot bar servicing customers who voluntarily leave; unenforceable after reduction-in-force unless salary paid; courts must blue-pencil; fee-shifting. The wizard omits the covenant when the employee's pay or status does not qualify and prints any required notice.
When is the final paycheck due in Nevada?
If discharged: immediately. If the employee resigns: next regular payday or within 7 days, whichever is earlier (NRS 608.020, 608.030). Wages must otherwise be paid at least semimonthly on regular paydays (NRS 608.060).
Does Nevada require paid sick leave?
Yes — Nevada paid-leave statute (NRS 608.0197): 0.01923 hours per hour worked, up to 40 hours per year; applies to 50+ employees (after 2 years of operation).
What salary makes an employee exempt in Nevada?
$684 per week ($35,568 per year) under the federal FLSA (29 C.F.R. § 541.600); Nevada sets no higher floor. The duties test must also be met.
Does Nevada limit invention assignment?
Yes. NRS 600.500 limits assignment to work-related inventions; the agreement prints the statutory carve-out in Section 6.
